RMS REHEARSAL ROOMS TERMS AND CONDITIONS

§1 General Provisions

1. The owner and operator of the rehearsal rooms is RMS E. Dzikowska, M. Fidecki sp.j., hereinafter referred to as "RMS".
2. These Terms and Conditions set out the rules governing the use of the rehearsal rooms and all musical equipment located on the RMS premises.
3. By booking a rehearsal room, the user confirms that they have read, understood, and accepted these Terms and Conditions in full.
4. The person making the booking is responsible for all individuals using the rehearsal room during the rental period.

§2 Rules for Using the Rehearsal Room

1. Users shall operate all equipment solely for its intended purpose and in accordance with proper operating procedures.
2. The following are strictly prohibited within the rehearsal rooms:
   • smoking tobacco products or any other substances;
   • consuming alcohol or using intoxicating or illegal substances;
   • altering equipment settings without prior approval from RMS staff;
   • removing any equipment from the premises without the prior written consent of RMS.
3. Users are required to keep the rehearsal room clean and tidy and to observe all applicable safety rules.
4. RMS reserves the right to refuse access to any person who appears to be under the influence of alcohol or intoxicating substances.

§3 Room Setup and Return After Use

1. The rehearsal room and all musical equipment must be left in the same condition and configuration in which they were provided at the beginning of the rental period.

2. Users may not alter the permanent configuration or positioning of equipment, including but not limited to:

   • drum kits;
   • microphones;
   • amplifiers;
   • stands;
   • PA (sound reinforcement) equipment,

   unless prior approval has been obtained from RMS staff.

3. At the end of the rehearsal, users are required to:
   • return the drum kit and all equipment to their original positions;
   • neatly arrange all cables and leads;
   • restore the room to its original layout;
   • leave the rehearsal room clean and tidy.
4. Failure to restore the room to its original condition or leaving the room untidy may result in an additional service charge and/or refusal of future bookings.

§4 Liability for Equipment

1. The user shall be fully financially liable for any damage caused during the rental period.
2. Such liability includes damage resulting from:
   • improper use of equipment;
   • incorrect setup or positioning of equipment;
   • the actions of any persons attending the rehearsal.
3. Any damage noticed before, during, or after use must be reported to RMS staff immediately.
4. All musical equipment and room facilities are inspected before and after each rental.
5. In the event of damage, the user shall cover the full cost of repair or replacement with equipment of equivalent quality and specifications.
6. RMS accepts no liability for loss of or damage to users' personal equipment brought onto the premises.

§5 Bookings and Payments

1. Rehearsal room bookings may be made by telephone, message, or directly with RMS staff.
2. Rental fees shall be charged in accordance with the current price list.
3. Cancellation shortly before the scheduled rehearsal may result in a cancellation fee, in accordance with arrangements made by RMS staff.
4. A booking is valid only for the individual or band that made the reservation.
5. Users may not sublet, transfer, or assign their booking to any third party without the prior consent of RMS.
6. If an unauthorized transfer or subletting of a booking is identified, RMS reserves the right to refuse access or terminate the rental without any refund.

§6 General Rules

1. Users are required to treat all musical equipment with due care and return it in no worse condition than when received.
2. Each user is also responsible for ensuring that the rehearsal room is returned to its original layout after use.
3. RMS staff reserve the right to deny further use of the rehearsal rooms to anyone who breaches these Terms and Conditions.
4. RMS accepts no responsibility for personal belongings left on the premises.
5. In the event of any breach of these Terms and Conditions, RMS reserves the right to terminate the rental immediately without refund.

§7 Final Provisions

1. These Terms and Conditions apply to all users of RMS rehearsal rooms.
2. Any matters not expressly regulated herein shall be resolved at the sole discretion of RMS or its authorized staff.
3. The current version of these Terms and Conditions is available on the RMS website and at the RMS premises.
